“Intersex: Third Gender in Germany” (Spiegel, Huff Post, Guardian, …): Silly Season Fantasies vs. Reality of Genital Mutilations

Fact #1: On 31.01.2013 the german federal parliament (Deutscher Bundestag) wrote into law an amendment in the Law on Civil Status, § 22 (3) PStG, which stigmatisingly prohibits ‘ambiguous’ newborns of having a sex registered:

PStG § 22 Abs. 3 [new]: ‘(3) If the child can be assigned to neither the female nor the male sex, then the child has to be entered into the register of births without such a specification.’

PStG § 22 Abs. 3 [neu]: ‘(3) Kann das Kind weder dem weiblichen noch dem männlichen Geschlecht zugeordnet werden, so ist der Personenstandsfall ohne eine solche Angabe in das Geburtenregister einzutragen.’

(There was no involvement or reference to a ‘recommendation’ or verdict by the constitutional court, as the mentioned articles claim – instead, as can be clearly seen from the original source Süddeutsche Zeitung, given as reference by the articles, the new § 22 (3) PStG is a specific intersex legislation that was, as the debate in parliament clearly proves, in fact based on the Recommendations by the German Ethics Council on Intersex in 2012. Nowhere there was a ‘third category’ or ‘option’ mentioned in the law nor in parliament, this part was mere speculation and daydreaming by journalists and pundits. The only part in the articles that is true, is the fact that this new law § 22 (3) PStG will be in effect from 01.11.2013.)

No Intersex-Organisation ever called for a mandatory ‘third category’ for persons concerned, let alone for children, nor to be prohibited to be registered as male or female. In contrary, for decades they have spoken out against such demands sometimes made in their name by non-intersex groups, and have criticised appropriation – and for good reasons:

For persons concerned, § 22 (3) PStG adds up to: Forced outings of intersex children – free reign for genital mutilators.

§ 22 (3) PStG amplifies the position of power of medicine to put pressure on parents concerned to ‘consent’ to having their otherwise ‘unacceptable’ children mutilated, or to a selective late-term-abortion.

Fact #3: On 27.06.2013 the german federal parliament (Deutscher Bundestag) issued the doctors an actual official licence to carry on with the mutilations – in spite of UN Committee on Torture (CAT) in 2011 calling upon Germany to investigate cosmetic genital surgeries on intersex children and to compensate survivors (CAT/C/DEU/CO/5, para 20), and in spite of the UN Special Rapporteur on Torture (SRT) in 2013 unmistakably condemning ‘involuntary genital normalizing surgery’ and ‘involuntary sterilization’ on ‘Children who are born with atypical sex characteristics’ (A/HRC/22/53, para 77, 76) …

UPDATE: And despite that

  • in 2013 the Council of Europe (COI) called for legislation to end “unnecessary medical or surgical treatment that is cosmetic rather than vital for health”  (Resolution 1952).
  • in 2015 the UN Committee on Torture (CAT) strengthened their 2011 recommendations, additionally calling for legislative measures not only to guarantee access to redress and compensation for survivors, but also to prevent perpetrators from continuing with IGM Practices (CAT/C/CHE/CO/7)

Nonetheless, also in Germany the daily Intersex Genital Mutilations (IGM) continue unhindered … 

THIS is the reality for intersex people in Germany (and many other countries)  – NOT gender-fantasies of an ‘option’ of ‘a “third gender” distinction on birth certificates’ as a ‘progressive measure for sexual minorities’.

We’re calling upon journalists and the media to ensure fairness and accuracy when reporting on intersex issues in the future. Thank you!

Doctors “playing God with childrens’ sex”

It’s a boy! It’s a girl! But what happens when life doesn’t fit in with greeting cards and the defining moment of childbirth becomes a bewildering puzzle?

Swiss intersex activist Daniela Truffer is spearheading a campaign to stop genital surgery and hormone treatment on children born with indeterminate sexual organs.

Truffer argues that affected individuals should be given the time to grow up and decide for themselves whether they wish to become male or female or remain in-between.

“Forced surgery can not be the answer,” she said, quoting medical studies that reveal poor outcomes and show that most patients suffer a lifetime of frustration and regret.

“These surgeries are painful and irreversible and most likely to reduce or remove sexual feeling. Non-consented cosmetic surgeries violate the right to physical integrity and self-determination. It’s a human rights issue,” Truffer told swissinfo.ch.

A condition that is seen in one in 2,000 births, people born neither fully male nor female have been an acknowledged part of society since Antiquity. But over time they became an invisible minority, particularly since “corrective” surgical intervention became the norm in the 20th century.

“Deutschland: Geschlechtseintrag ‘unbestimmt’ ab 1. November wählbar”, behaupten Spiegel (16.08.), Huffington Post (17.08), rt.com (17.08.), Guardian (18.08.), Guardian (19.08.), etc.

Diese (und weitere) Behauptungen beruhen allerdings nicht auf Fakten, sondern auf hypothetischen Spekulationen.

Dieser Blog fragt: Wann endlich werden Intersex-Genitalverstümmelungen nicht mehr ausgeblendet – und kommen bei Artikeln zum Thema auch Betroffene und ihre Organisationen Wort?

Fakt 1: Am 31.01.2013 beschloss der Deutsche Bundestag einen Zusatz im Personenstandsgesetz, den neuen § 22 (3) PStG, wonach künftig bei körperlich “uneindeutigen” Neugeborenen kein Geschlechtseintrag mehr zuzulassen sei – letztlich ein diskriminierendes und stigmatiserendes Verbot für “uneindeutige” Neugeborene, ein Geschlecht eintragen zu dürfen:

PStG § 22 Abs. 3 [neu]: „(3) Kann das Kind weder dem weiblichen noch dem männlichen Geschlecht zugeordnet werden, so ist der Personenstandsfall ohne eine solche Angabe in das Geburtenregister einzutragen.“

(Entgegen der Behauptung in den obigen Artikeln, der Absatz basiere auf einer “Empfehlung des Bundesverfassungsgerichts”, hat sich das BVG betreffend Kinder mit “atypischen” körperlichen Geschlechtsmerkmalen bisher nie geäußert. Wie im – von obigen Artikeln als Quelle angegeben – Bericht der Süddeutsche Zeitung (16.08.) festgehalten, zielt der neue § 22 (3) PStG auf Intersex-Kinder, und basiert laut Verlautbarungen aus dem Bundestag (u.a. Familienministerin Schröder) auf den Empfehlungen des Deutschen Ethikrates in dessen Intersex-Stellungnahme von 2012. Weder im Gesetzestext noch im Parlament wurde ein “3. Personenstand” erwähnt – davon war ausschließlich in Spekulationen und Wunschträumen obiger JournalistInnen und “ExpertInnen” die Rede. Das einzige, was in den obigen Berichten zutrifft, ist die Tatsache, dass der neue § 22 (3) PStG am 1. November in Kraft tritt.)

Keine Betroffenenorganisation hat je die Einführung einer obligatorischen “3. Kategorie” für alle Betroffenen gefordert, erst recht nicht für Intersex-Kinder, geschweige denn, dass ihnen nicht mehr erlaubt sein soll, als männlich oder weiblich eingetragen zu sein. Im Gegenteil, Betroffenenorganisationen sprechen sich seit Jahrzehnten gegen solche Forderungen aus und kritisieren Vereinnahmung – und zwar aus guten Gründen:

Der neue § 22 (3) PStG bedeutet für Betroffene: Zwangsouting für Intersex-Kinder – Freipass für Genitalverstümmler.

§ 22 (3) PStG verstärkt die Machtposition der Medizin, Eltern noch mehr unter Druck zu setzen, weiterhin Kinder verstümmeln zu lassen, oder wegen “Unzumutbarkeit” selektiv spätabzutreiben.

Fakt 3: Am 27.06.2013 erteilte der Bundestag den GenitababschneiderInnen offiziell die Lizenz zum ungestörten Weiterverstümmeln – obwohl 2012 der UN-Folterausschuss CAT die Bundesrepublik explizit aufforderte, kosmetische Genitaloperationen an Intersex-Kindern zu untersuchen und Überlebende gesetzlich zu entschädigen (CAT/C/DEU/CO/5, Abs. 20), und obwohl 2013 der UN-Sonderberichterstatter über Folter “genital-normalisierende Zwangsoperationen” und “Sterilisierung” an “Kindern, die mit atypischen körperlichen Geschlechtsmerkmalen auf die Welt kommen” unmissverständlich verurteilte (A/HRC/22/53, Abs. 77, 76) …

DAS ist (nicht nur) in Deutschland die Realität der Betroffenen – NICHT Gender-Fantasien um eine “neue Kategorie «unbestimmt»” als “wichtiger Schritt zur Anerkennung der freien Geschlechtswahl”.

Wir rufen JournalistInnen und Medien dazu auf, bei Berichten zu Intersex-Themen künftig vermehrt auf Fairness und Faktentreue zu achten. Danke!

»Clitoral surgery on children is brutal and illogical, and no matter what name you give it, it is a mutilation. When I use the word mutilation, I can hear doors slamming shut in the minds of doctors all over this country. John Gearhart, a pediatric urologist at Johns Hopkins, has said, “To compare genital mutilation of young girls in Africa to reconstructive surgery of a young baby is a giant, giant leap of misrepresentation.” But neither Dr. Gearhart, nor anyone else, has ever bothered to ask those of us subjected to clitoral surgery as children if being taken to the hospital without explanation, having your healthy genitals cut and scarred, then left alone with the results feels like mutilation or “reconstructive surgery.” Gearhart’s mistake is to judge surgery only by the surgeon’s intent, and not by the effect on the child. I spoke with a woman recently who is young enough to be my daughter. With great effort, she told me of her clitoral surgery as a child. She implored me, “Why do they have to cut so deep, Martha? Why do they do that?”«

‘Another new program recently started by Pediatric Urology is the Vaginal Enhancement in Unique Situations, or VENUS Clinic for vaginal inadequacy. There are many different diagnoses that can result in vaginal inadequacy, such as Complete Androgen Insensitivity Syndrome, Mayer Rokitansky Kuster Hauser Syndrome and cloacal anomaly/exstrophy situations, to mention a few. There is also multidisciplinary representation in this clinic, including Pediatric Gynecology. These patients can present as neonates or as older adolescents. […] Our goal is to treat patients with vaginal inadequacy in a very sensitive, individualized, age-appropriate, patient-directed manner. […] The patients treated in the newly formed Disorders of Sexual Differentiation Clinic […] may [ultimately] also need the expertise of the new VENUS Clinic.’

Perpetrators of Intersex Genital Mutilations from more than 84 (!!!) countries all over the globe will gather in Berlin, looking to increase their business – that is the ones actually wielding the scalpels!  (See wofaps2013.com for details + programme)

‘Hypospadias repair’ and ‘DSD’ are once again part of the programme of the ‘4th World Congress’ – human rights, ethics, and persons concerned aren’t – so far, same old.

In addition to the usual Peaceful Intersex Protests in front of the mutilators’ conference  (+ the upcoming call to sign the Open Letter), we CALL FOR YOUR HELP to expose the intersex surgeons, and make it stick, by digging up and collecting some of the evidence available online e.g. on paediatric university clinics’ listed treatments and related info, in publications by members of their staff, and then cross-referencing to the WOFAPS programme and regional member association.  

–> Please find a compiled list of WOFAPS member associations. Practical tip for investigations: Wherever there is a major regional (pedo) clinic with dedicated pedo endo and pedo surgeons / urologists / gynaecologists et al. departments, a relevant collection of dirt on the 3 most common surgeries – ‘hypospadias repair’, ‘clitoral reduction’ +/-  ‘vaginoplasty’, and castration – should be hit pretty soon in the pedo surgeons’ department, as well as for other relevant surgeries / treatments. Then cross-referencing these findings to the WOFAPS association member list and conference programme should match representation/involvement at/with the conference/WOFAPS.

We ask people to publish their collected evidence online (if possible), stating the specific surgeries / treatments evidenced, plus relevant quote(s) + source(s), so we can refer to this publication in the open letter when listing current practices. However, it’s also cool to just email us your findings (your details can also be withheld on request).

Preaching CAIS Castration and Supposedly ‘High Cancer Risk’, again at the ‘9th Joint Meeting of Paediatric Endocrinology’

    
1.  ‘High Cancer Risk’ as Justification for CAIS Castrations

Doctors and clinics treating intersex ‘patients’, especially paediactric endocrinologists and their departments, still propagate and perpetrate so called ‘prophylactic’ castrations a.k.a. gonadectomies on CAIS ‘patients’ (Complete Androgen Insensitivity Syndrome, i.e. people developping a female appearance due to their bodies not reacting to testosterone at all, despite XY caryotype and having mostly undescended testicles producing testosterone, which then is made into estrogens by the body, hence the female appearance).

The rationale behind these medically unnessesary castrations with all their ‘unpleasant consequences’ (Hauser, 1961/63, see below 3.) is a) an alleged ‘high cancer risk’, and b) ‘psychological distress’ of the ‘patients’ (that were and still are told by doctors to be ‘normal women’ with ‘malformed ovaries’), or rather the parents and doctors themselves.

Due to organised criticism by self-help groups during the 25 years leading to ‘new’ assessments of the alleged cancer threat (e.g. Cools et al. 2006 stats | fulltext; Looijenga et. al. 2007 stats | fulltext; Pleskacova et al. 2010 stats | fulltext), there have been some recent positive developments exposing the ‘high risk’ as a convenient and profitable lie by doctors (which has been known and criticised by insiders since at least 1956, see below 3.).

However, many doctors and clinics are still selling the ‘high cancer risk’ lie, and continue to propagate and perpetrate harmful, medically not necessary castrations.
 

2.  Examples of Doctors, Universities, and Clinics
Represented at the ‘9th Joint Meeting of Paediatric Endocrinology’
and Recommending ‘Prophylactic’ CAIS Castrations:

a)  Naples, Italy – Federico II University of Naples, Pediatric Endocrinology Unit:
Prof. Dr. Mariacarolina Salerno contributes to 5 poster presentations at the ‘9th Joint Meeting’, incl. Sex Differentiation 2, P1-d2-588: ‘A novel heterozigous mutation in steroidogenic factor 1 in a 46,XY patient with ambiguous genitalia but without adrenal insufficiency’
In the journal La Repubblica, 28.08.2013, Prof. Dr. Mariacarolina Salerno addresses the public recommending CAIS castrations as follows (translated from Italian):

‘In the first case [PAIS = Partial AIS] it’s often possible to assign the male gender, to correct the atypical genitalia surgically and prescribe a hormone therapy. In the second case [CAIS] it’s necessary to assign the female gender and in puberty we recommend removing the gonads.’

b)  São Paulo, Brazil – The University Hospital of the Medical Faculty of São Paulo:
Prof. Dr. Berenice B. Mendonca contributes to no less than 8 presentations within the programme of the ‘9th Joint Meeting’, mostly related to Intersex/’DSD’, and incl. the prestigious ‘SLEP “Cesar Bergadá Lecture”‘ PL6-7: ‘Long-term follow-up of patients with disorders of sex development (DSD)’. Prof. Mendonca is well-known for constantly recommending medically not necessary, mutilating surgeries (see also Open Letter to ‘I-DSD 2013’, p 2). Regarding CAIS castrations see e.g. her 2009 publication ’46,XY disorders of sex development’ (PDF) p 21-22):

Gonadectomy should be performed because of the increased risk of testicular tumours, although a recent study showed that tumor risk is low in CAIS patients before and during puberty.[64] We favour prepubertal gonadectomy, after diagnosis, and then induction of puberty with oestrogens at the appropriate age.This approach diminishes the time that the girl has an inguinal mass and surgery is better handled psychologically by a young child than an adolescent. However, the optimal timing for gonadectomy in CAIS patients is controversial and some authors advise to postpone gonadectomy until after spontaneous breast development at puberty.[65] In our experience, breast development is similarly obtained with endogenous oestrogenization or with pharmacological replacement.’

c)  Innsbruck, Austria – The Medical University of Innsbruck:
The University’s Paediatric Departement is represented 3 times within the programme of the ‘9th Joint Meeting’, though with non-intersex topics. However, e.g. the University’s Pediatric Course of Winter Semester 2011/12 (PDF) [ TRIGGER WARNING!!! ] teaches on p 28 (translated from German):

Therapy:
∙ leaving the gonads until the end of puberty
∙ physiologically female development of puberty
∙ thereafter removal of the gonads because of cancer risk
∙ substitution with estrogens and gestagens’

And these are just three random examples! As a rule of thumb: Scratch any presenter at the ‘9th Joint Meeting’, and you’ll find mostly a personal perpetrator of Intersex Genital Mutilations, or at the very least a genital mutilators’ clinic/university!
 

3.  Unnecessary and Harmful: Medical Criticism since at least 1956

The well-known surgeon and endocrinologist Georges André Hauser (1921-2009), one of the name patrons of the Mayer-Rokitansky-Küster-Hauser Syndrome (MRKHS), was probably the most staunch criticist of CAIS castrations since at least 1956, i.e. before systematic castrations became a de-facto medical standard – despite that even then it was well known, that castrations were not medically necessary, but indeed harmful.  

In the influential 1963 medical textbook ‘Intersexuality’ (edited by Claus Overzier, German editition 1961), G. A. Hauser contributed a chapter on ‘Testicular Feminization’, as CAIS was called then. There he criticised the castrations unmistakably, denouncing the medical myth of ‘High Cancer Risk’.

‘a) The risk of malignant change is not as great as has been suggested. […] Jones and Scott (1958) also state that malignant change occurs in less than 5% of the cases.’

‘d) The castration of patients without a tumour converts symptomless individuals into invalids suffering from all the unpleasent consequences of castration. […]’

‘e) Castration upsets a state of biological equilibrium that has been built over a long period of time. Since most of these patients have normally or even very well developped breasts and sexual feelings, it is very difficult to restore this ideal state by replacement therapy.’

‘f) Other autors state that they remove the gonads, because they do not correspond to the external, psychosocial and psychosexual sex of the patients. This is a costly mistake, because these gonads produce estrogens. […]’

So, despite that the medical community has known very well and for a long time about the exaggerated ‘high risk’ and the negative consequences, they did (and still do!) preach medically not necessary, harmful castrations on vulnerable patients none the less!
